Drone / RPAS / UAV Insurance

As of December 31, 2020, the European UAS regulation is applicable. This regulation affects all drones regardless of their use or size.

Consolidated European regulation:

• Consolidated Implementing Regulation (EU) 2019/947 including changes to Implementing Regulation (EU) 2020/639 and Implementing Regulation (EU) 2020/746.
• Delegated Regulation (EU) 2019/945 consolidated including the changes of Delegated Regulation (EU) 2020/1058.

As regards compulsory insurance, the regulations in force continue to be those contemplated in the following regulations in force until further notice:

• Royal Decree 37/2001of January 19, 2001, updating the amount of compensation for damages provided for in Law 48/1960 of July 21, 1960, on Air Navigation.
• Law 48/1960of July 21, 1960 on Air Navigation.
• Regulation EC 785/2004

The distinction is still based on the maximum take-off weight MTOW higher or lower than 20 kgs.

Drones weighing 20 kgs MTOW or moremust comply with the specifications required in Regulation 785/2004, thus, the limits offered are as follows:

• Liability limit of 300.000 EUR
• Liability limit of 500,000 EUR
• Liability limit of EUR 1,000,000 (with an excess of EUR 250 for property damage).

If the operations to be carried out go beyond our borders, it is important to verify whether higher limits are required in the state where the operation is to be carried out. In most EU countries, civil liability limits of EUR 1,000,000 are contracted.

Currently we can insure drones depending on commercial or private use.
